Disposizioni contrattuali
Le Disposizioni contrattuali generali (<Disposizioni>) si applicano alla vendita di veicoli e di accessori (<Oggetto>) fra Venditore e Compratore sulla base di un accordo scritto (<Contratto di compravendita>) che rimanda alle presenti Disposizioni.
2.Caratteristiche del veicolo
I dati inerenti al veicolo conformemente al Contratto di compravendita si applicano con riserva di eventuali modifiche costruttive apportate in fabbrica. I dati riportati nel presente contratto nonché in opuscoli, offerte, conferme d’ordine, ecc., in particolare quelli relativi a pesi, misure, consumi, costi di esercizio, velocità, ecc., sono da intendersi meramente come valori approssimativi. Auto Kunz AG non garantisce che l’automobile usata corrisponda al Body-Index A (non incidentata) in conformità con www.vfas.ch e neppure che non sia stata utilizzata o noleggiata per il trasporto commerciale di persone, salvo il caso in cui ciò sia riportato per iscritto nel contratto. I veicoli di importazione possono presentare varianti di modello, equipaggiamento e motore che differiscono dalle specifiche dei modelli importati dall’importatore principale e componenti elettronici, come il computer di bordo, ecc., non impostati in lingua tedesca. Si tratta per lo più di veicoli che anche come automobili nuove hanno una precedente immatricolazione giornaliera all’estero.
Sulla base delle condizioni e degli accordi riportati nella 1a pagina del contratto. Nel caso sia stata concordata una garanzia di fabbrica, per l’inizio della garanzia di automobili nuove o di veicoli con garanzia del costruttore in corso di validità fa fede non la data della prima entrata in circolazione bensì l’inizio della garanzia registrato nel sistema del costruttore oppure l’eventuale inizio della garanzia pattuito contrattualmente. Auto Kunz AG non si assume alcuna responsabilità in merito all’esercizio dei diritti di garanzia nei confronti del costruttore o dei partner contrattuali di quest’ultimo. Può accadere che il costruttore o i suoi partner contrattuali ostacolino o rigettino le prestazioni in garanzia.
Il prezzo di vendita è vincolante per ambo le parti e non varia. Fa fede l’importo convenuto contrattualmente. Non sono previste rettifiche di prezzo, ad es. a fronte di maggiorazioni o riduzioni del prezzo né di variazioni del tasso di cambio, inflazione, deflazione, ecc.
Il Compratore dichiara esplicitamente che l’oggetto in permuta consegnato a titolo di pagamento è esente da diritti o riserve di proprietà da parte di terzi; fino al momento della consegna ad Auto Kunz AG dell’oggetto in permuta il rischio di deperimento, danneggiamenti o deprezzamento è a carico del Compratore. Il Compratore conferma e garantisce che il veicolo in permuta corrisponde al Body-Index A in conformità con www.vfas.ch e che il numero di chilometri riportato dal contachilometri corrisponde ai chilometri effettivamente percorsi. Qualora dopo la consegna del veicolo in permuta dovessero riscontrarsi difetti non rilevati durante la consegna stessa, entro due anni Auto Kunz AG potrà richiedere il risarcimento del danno. Il Compratore risponde di tali danni rilevati in un secondo tempo. Nel caso il veicolo in permuta non venga consegnato, si applica una penale in ragione del 30% del prezzo d’acquisto e comunque non inferiore a CHF 1’000.-.
Il Compratore accetta ritardi nella consegna fino a 150 giorni. Scaduto questo termine accettato di ritardo nella consegna, il Compratore può, previo sollecito scritto, fissare per iscritto una proroga di 60 giorni. Trascorso inutilmente tale termine, il Compratore potrà recedere dal presente contratto senza incorrere in alcuna pretesa di risarcimento danni. Per essere valido il recesso deve essere notificato a mezzo lettera raccomandata. Il Compratore rinuncia espressamente a far valere diritti per ritardo nella consegna dell’Oggetto, in particolare non sussiste alcun diritto a un veicolo sostitutivo.
Se il Compratore ritarda la presa in consegna dell’Oggetto, Auto Kunz AG può a) esigere l’adempimento e richiedere il risarcimento per il ritardo, oppure b) dichiarare l’immediata rinuncia a una consegna successiva e pretendere una penale del 20% del prezzo di vendita. Il presente Contratto di compravendita costituisce un riconoscimento del debito da parte del Compratore ed elimina pertanto tutte le eventuali opposizioni.
Fino al completo pagamento del prezzo dovuto, inclusi eventuali interessi di mora e spese, Auto Kunz AG ha il diritto di iscrivere una riserva di proprietà sul veicolo e relativi accessori nel registro dei patti di riserva della proprietà ai sensi dell’art. 715 CC.
Se il prezzo di vendita residuo non viene pagato secondo i termini contrattuali, Auto Kunz AG può recedere dal contratto. Il risarcimento si calcola come indicato in seguito: 25% del prezzo di vendita per la svalutazione del veicolo per auto nuove e usato, più il 2% del prezzo di vendita per ogni mese e 25 centesimi per ogni chilometro percorso, ognuno calcolato a partire dalla consegna del veicolo.
Qualora il presente contratto non fosse concluso da personale autorizzato a firmare di Auto Kunz AG, quest’ultima può dichiarare entro 20 giorni per iscritto di non essere vincolata al contratto. In tal caso non deve versare alcun risarcimento. Ai sensi di questa riserva di consenso, si intendono persone autorizzate a firmare solo i collaboratori iscritti nel registro di commercio accessibile pubblicamente.
Se Auto Kunz AG a causa del fornitore o del costruttore non fosse in grado, senza colpa, di consegnare il veicolo dopo il termine della riserva di approvazione, Auto Kunz AG lo dichiara per iscritto al Compratore. In questo caso Auto Kunz AG non deve alcun risarcimento.
Nel caso la prima pagina del presente Contratto di compravendita riporti un pacchetto di assistenza gratuita di Auto Kunz AG come parte integrante del contratto stesso, a tale pacchetto si applicano le disposizioni seguenti: Durata: 3 anni oppure 30‘000 Km, a seconda della condizione che si verifica per prima, a decorrere dalla data di inizio della garanzia. Servizi inclusi in base alle direttive del costruttore. Auto Kunz AG si fa carico dei costi di manodopera e di materiale. Sono esclusi tutti i liquidi e i materiali soggetti a usura. Gli interventi supplementari e gli altri lavori saranno fatturati separatamente. Occorre rispettare gli intervalli indicati nel libretto di manutenzione. La tolleranza di accettazione è di 1 mese/1000km Tutti i lavori devono essere eseguiti solo dal garage Auto Kunz AG oppure dai partner per l’assistenza elencati separatamente. Non cumulabile con altre promozioni o altri buoni.
I dati personali vengono elaborati nel rispetto della legge sulla protezione dei dati. I dati personali sono memorizzati ed elaborati esclusivamente al fine di fornire assistenza personalizzata al Compratore, di inviargli informazioni sui prodotti oppure di sottoporgli offerte di assistenza. Per maggiori delucidazioni sull’uso dei dati personali da parte del Venditore si rimanda all’informativa sulla protezione dei dati personali (parte integrante delle presenti Disposizioni) pubblicata sul sito web del Venditore.
Le autorità competenti emettono una fattura separata per le tasse e le imposte di immatricolazione del veicolo che sono a carico del Compratore. Auto Kunz AG non ne risponde in solido.
Le parti convengono che per la validità del presente contratto nonché di tutte le eventuali modifiche e integrazioni apportate allo stesso è richiesta la forma scritta.
Il foro competente per eventuali controversie derivanti dal presente contratto e dai rapporti commerciali da esso scaturiti è il tribunale di competenza nel luogo ove ha domicilio Auto Kunz AG. Il Compratore dichiara espressamente di rinunciare al foro ordinario competente presso il proprio luogo di residenza e di accettare il foro concordato da contratto.

As a driver of an Auto Kunz AG vehicle, you grant Auto Kunz AG the right to use the following data – in anonymised form – to help improve our service.
During the contract period, we receive information from the vehicle tracker about kilometre stand, routes travelled and location. We are entitled to use the data to improve our offers, but undertake to make it anonymous and to treat it confidentially in dealings with third parties. By making use of the service, customers agree to the processing of their data.

Amendments

Il diritto di restituzione è valido solo in cambio di un’auto nuova o usata in magazzino e di proprietà di Auto Kunz AG al prezzo di vendita pubblicizzato. L’auto sostitutiva può essere più costosa o inferiore del 10% rispetto al valore di cambio. Gli accessori aggiuntivi acquistati sul veicolo, i costi di iscrizione e i servizi aggiuntivi (come garanzie extra, pneumatici invernali, ecc.) non verranno conteggiati al momento della restituzione. Vantaggi e rischi sono trasferiti all’acquirente al momento della consegna, indipendentemente da un diritto di restituzione rivendicato in modo prudente. Dopo il reso scritto e confermato, i benefici e i rischi vengono trasferiti ad Auto Kunz AG. Il diritto di restituzione non può essere fatto valere al fine di recuperare un veicolo eventualmente scambiato al prezzo di cambio corrente, esclusi i diritti di restituzione da concessionari, esportatori, autorimesse e persone che lavorano nel settore automobilistico e delle società.
In questo leasing All Inclusive (nel settore chiamato anche Full Leasing) sono inclusi i seguenti costi operativi:
La durata del contratto del leasing All Inclusive va da 36 a 60 mesi. Le ci indica la durata e il chilometraggio annuale desiderati e noi calcoliamo la sua rata mensile. Alla scadenza del contratto può restituirci il veicolo, attivare il finanziamento per uno nuovo o acquistare il veicolo per il valore residuo calcolato.
